These terms are an agreement between you and Crescere Studios (“we”, “us”) for the Tempus app. By using Tempus you accept them. If you do not, do not use Tempus.
Tempus is a focus tool. You study to earn Miles, and you spend Miles to unlock apps that Tempus blocks for you using Apple’s Screen Time framework. It is a habit aid you set up for yourself. It is not a parental control, a security product or a medical device.
You may use Tempus without an account. Signing in with Apple or Google creates an account and backs your data up. You are responsible for the device and the sign-in you use. You must be 13 or older to create an account.
Miles are points inside Tempus. They have no monetary value, cannot be redeemed for money, and cannot be bought, sold or transferred except through the app’s own features (a gift, or a shared bank). Miles are earned only by completed flights. We may correct a balance that was produced by a bug or by tampering, and we may change the rates at which Miles are earned and spent in a future version of the app; a change never takes away Miles you already hold.
Tempus asks iOS to block the apps you choose and to lift the block when you spend Miles. Blocking depends on Apple’s Screen Time framework and on permissions you grant in iOS. You can change those permissions, remove Tempus, or bypass the block through the system at any time, and Tempus cannot stop you. That is by design: Tempus helps you keep a promise to yourself. It does not enforce one.
The focus guard may divert a flight when the phone is moved or the app is left, based on sensor readings and the settings you chose. Sensors are imperfect. A diverted flight earns no Miles and is not refunded.
Business Class is an auto-renewing subscription sold and billed by Apple through the App Store, in the currency and at the price shown there before you buy. It renews automatically at the end of each period unless you cancel at least 24 hours before the period ends. You manage and cancel it in your Apple ID settings, not in Tempus. Where a free trial is offered, the subscription starts when the trial ends unless cancelled before then. If we change the price, Apple will tell you and ask for your consent where the law requires it.
Apple is the seller of every purchase made in Tempus and handles all refunds under its own policy. Request a refund at https://reportaproblem.apple.com. We cannot issue refunds ourselves and cannot see your payment details. Nothing in these terms limits the rights you have under the Australian Consumer Law or any other consumer law that applies to you, including the guarantee that a digital service will be fit for its purpose and the remedies that follow if it is not.
Linking banks with another member creates a shared pot that either of you can spend from. Either of you may unlink at any time, and the pot is then split evenly between you. You are responsible for who you link with. We do not mediate disputes about a shared pot.
Do not tamper with Tempus, its data or its server; do not try to obtain Miles or Business Class other than as the app intends; do not use Tempus to harass another member, including through invitations or gifts; and do not use Tempus in a way that breaks the law. We may suspend or delete an account that does.

Tempus, its design, its artwork and its name belong to Crescere Studios. You get a personal, non-transferable licence to use the app on Apple devices you own or control, under the App Store’s terms. You may not copy, modify, sell or reverse-engineer it except where the law allows.
We may change, suspend or discontinue any part of Tempus, including the account server, at any time. We will try to give notice of anything that affects your data. Tempus is provided as it is. To the extent the law allows, we make no warranty beyond those that cannot be excluded, and we are not liable for loss that was not reasonably foreseeable, for indirect loss, or for any amount beyond what you paid us in the twelve months before the claim. Nothing here excludes liability that cannot be excluded by law, including under the Australian Consumer Law.
These terms are between you and us, not Apple. Apple has no obligation to support or maintain Tempus. If Tempus fails to conform to a warranty that applies, you may tell Apple and Apple may refund the price you paid; Apple has no other warranty obligation. Apple is not responsible for any claim relating to Tempus, including product liability, legal or regulatory compliance, or intellectual property. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not in a country under a United States embargo and are not on a prohibited-parties list.
You may stop using Tempus at any time, and delete your account in the app. We may end this agreement if you break it. The sections on Miles, refunds, our property, availability and Apple survive.
If these terms change, the new version ships with the app and its effective date moves. Continuing to use Tempus after that means you accept the change.
These terms are governed by the laws of New South Wales, Australia, and disputes are subject to the courts of New South Wales, without limiting your rights under the consumer law of the place you live.
